TERMS AND CONDITIONS OF TRAVEL AND DAY TRIPS


1. Scope.

These Terms and Conditions apply to the sale of tickets for the heritage “Treno di Dante” and tourist packages offering transportation on the aforesaid heritage train and other additional services in a 24-hour period (excluding packages which include overnight services) by the company Il Treno di Dante s.r.l..


2. Travel arrangements.

Travel on the heritage train and the services included in the packages referred to in the previous article take place in all weather conditions.Departure times are fixed; they are set by the railway network manager and Il Treno di Dante s.r.l. must respect them. Il Treno di Dante s.r.l. shall therefore not be liable for passengers who arrive later than the scheduled departure time and are unable to use the service.


3. Refunds and changes.

Tickets for the heritage train and the packages referred to in article 1 are non-refundable. The date of the ticket and the package may be changed once up to 72 hours before the scheduled departure time and will incur a charge of Euro 10.00.

If passengers decide not to complete the whole journey on the ‘Treno di Dante’ and to alight at one of the intermediate stations, they shall be entitled to a refund from Il Treno di Dante of the cost of a ticket for a standard FS train to reach the final destination of the ‘Treno di Dante’. To obtain the refund, passengers shall: (i) notify the stewards on the train in plenty of time that they wish to alight at one of the intermediate stops; (ii) ask the stewards for a copy of the instructions to apply for a refund; (iii) follow the steps in the instructions and provide all the information requested. Passengers shall be responsible for any mistakes they make when applying for the refund or any incorrect information they may give. They shall also be responsible for purchasing any train tickets they may need to continue their journey and/or go back from the station where they alighted.


4. Cancellations.

If journeys on the heritage train or the services included in the packages referred to in article 1 are cancelled for reasons beyond the control of Il Treno di Dante s.r.l., including force majeure, temporary unavailability of the railway line, mayoral decree and/or actions taken by other public authorities which make it impossible to run the train and/or services, passengers may change the date of their ticket or package free of charge, provided the service is available on the new date.


5. Replacement of the heritage locomotive.

Il Treno di Dante s.r.l. shall not be liable if the heritage locomotive is replaced, for technical reasons or due to force majeure, by another form of transport of a non-historical nature. The decision to replace the heritage train is the sole responsibility of Fondazione FS Italiane and/or Trenitalia which manage the railway line and the transportation service. If this happens, passengers are not entitled to a refund.


6. Disruption and delays. Refunds for delays.

Il Treno di Dante s.r.l. shall not be liable for any damage, delays, disruption and/or cancelled services due to causes beyond its control, including force majeure, temporary unavailability of the railway line, mayoral decree and/or actions taken by other public authorities which make it impossible to run the train.
If the heritage train arrives at its destination more than 120 minutes after its scheduled arrival time, passengers shall be entitled to request a refund of 10% of the price of the ticket or package from Il Treno di Dante s.r.l..


7. Luggage. Responsibility.

There are no restrictions to the amount of luggage passengers may take on the heritage train. Passengers are responsible for loading and unloading their luggage and looking after it. They will also be solely responsible for any damage caused by their luggage to property or people, including staff on the heritage train. Il Treno di Dante s.r.l. shall under no circumstances be liable for damage to and/or the loss of luggage and/or passengers’ belongings.


8. Stowing bicycles and luggage in the designated carriage.

Passengers travelling with bicycles (or oversized luggage which cannot be stored in the passenger carriage of the train) must stow them in the designated carriage. Passengers shall be responsible for loading and unloading their bicycle/luggage. They shall be liable for their bicycle and any damage caused by it to other bicycles and/or property or people, including staff on the heritage train. Il Treno di Dante s.r.l. shall under no circumstances be liable for damage to and/or the loss and/or theft of bicycles.


9. Animals.

Dogs, cats and other small pets may be taken on the train free of charge, except for special exceptions. Under no circumstances may animals allowed in the carriages occupy seats intended for passengers. If an animal causes a nuisance to the other passengers, the train staff will ask the owner to move to another free seat. All dogs, except guide dogs, must have a muzzle and must be kept on a lead; they must also have a certificate of registration on the canine registry which must be shown whenever requested by train staff and when purchasing tickets, where applicable. Owners are responsible for looking after their animals and are liable for any damage caused by their animals to property and/or people, including staff on the heritage train.


10. Applicable law.

The contract entered into with passengers is governed by Italian law.


11. Disputes and jurisdiction.

The parties forthwith undertake to amicably resolve any disputes which may arise in relation to this contract. If an amicable settlement is not reached, the Law Court of Bologna shall have sole jurisdiction over any dispute which may arise in relation to the interpretation, execution and validity of the contract.


12. Passengers with reduced mobility and disabilities.

The unique layout of the heritage train and the lack of equipped seats means it is physically impossible for passengers with wheelchairs or similar mobility devices to board and travel on the train.


13. COVID-19 self-declaration.

By accepting these terms and conditions, in order to use the service, passengers declare under their own responsibility and are aware of the legal and criminal consequences in the event of false statement that:

  • they are not currently positive for COVID-19;
  • they are not currently subject to self-isolation and/or quarantine requirements in accordance with current COVID-19 regulations;
  • they have not had a temperature of over 37.5 degrees, cough, difficulty breathing, flu-like symptoms, conjunctivitis or diarrhoea in the 14 days prior to using the service;
  • they have not been in contact with anyone suffering from COVID-19 in the 14 days prior to using the service;
  • they have not been in contact with anyone in quarantine in the 14 days prior to using the service;
  • they have not visited areas considered to be at risk from the virus in the 14 days prior to using the service;
  • they have not been in contact with people from areas considered to be at risk from the virus in the 14 days prior to using the service;
  • they will comply with the rules on social distancing and the mandatory use of face coverings on board the heritage train and on the ground in the areas where required.
